1. Acceptance of Terms
By accessing and using the services provided by Locked In Escape ("we," "us," or "our"), you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and others who access or use our escape room facilities, website, and related services. If you do not agree to these terms, please do not use our services.
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new terms.
2. Description of Services
Locked In Escape provides immersive escape room experiences, team building activities, and entertainment services in Canada. Our services include but are not limited to:
- Interactive escape room games and challenges
- Private group bookings and corporate events
- Birthday parties and special occasion celebrations
- Team building workshops and activities
- Educational webinars and design masterclasses
All services are subject to availability and may be modified or discontinued at our discretion without prior notice.
3. Booking and Payment Terms
Reservations must be made in advance through our booking system or by contacting us directly. Payment is required at the time of booking to secure your reservation. We accept major credit cards and other payment methods as specified during the booking process.
All prices are listed in Canadian dollars and include applicable taxes unless otherwise specified. Prices are subject to change without notice, but any changes will not affect confirmed bookings.
Group bookings may require a deposit, and full payment must be completed before the scheduled experience. Corporate accounts may be eligible for invoicing arrangements subject to credit approval.
4. Cancellation and Refund Policy
We understand that plans can change. Our cancellation policy is designed to be fair while protecting our business operations:
- More than 48 hours: Full refund or free rescheduling
- 24-48 hours: 50% refund or free rescheduling with $25 fee
- Less than 24 hours: No refund, rescheduling subject to availability with 50% fee
- No-show: No refund or rescheduling options
Refunds will be processed within 5-10 business days to the original payment method. We reserve the right to make exceptions to this policy in cases of emergency or extraordinary circumstances.
5. Age Requirements and Supervision
Our escape rooms are designed for participants aged 10 and older. Children under 16 must be accompanied by an adult supervisor (18+ years old) who remains with the group throughout the entire experience. The adult supervisor is responsible for the conduct and safety of all minors in their care.
Some rooms may have specific age recommendations based on content, difficulty level, or thematic elements. We reserve the right to refuse entry to participants who do not meet the age requirements for specific experiences.
6. Health and Safety Requirements
Participation in our escape room experiences may involve physical activity, problem-solving under time pressure, and exposure to various environmental effects including dim lighting, sound effects, and enclosed spaces. Participants should consider their physical and mental health before participating.
We do not recommend participation for individuals with:
- Heart conditions or high blood pressure
- Claustrophobia or severe anxiety disorders
- Pregnancy (without medical approval)
- Recent injuries or mobility limitations
- Seizure disorders triggered by flashing lights or sounds
Participants must inform us of any medical conditions or accessibility needs when booking. We will make reasonable accommodations where possible but cannot guarantee that all experiences will be suitable for all participants.
7. Code of Conduct
All participants must conduct themselves in a respectful and appropriate manner. Behavior that is disruptive, offensive, or dangerous will result in immediate removal from the premises without refund. Prohibited behaviors include but are not limited to:
- Intentional damage to props, equipment, or facilities
- Use of excessive force or violence against any property
- Harassment or inappropriate behavior toward staff or other participants
- Use of alcohol, drugs, or other controlled substances
- Bringing prohibited items including weapons, outside food, or beverages
We maintain video surveillance in common areas for security purposes. Game rooms may be monitored for safety and to provide assistance when needed.
8. Liability and Risk Assumption
By participating in our escape room experiences, you acknowledge and assume the risks associated with the activity. While we maintain our facilities to high safety standards, participation involves inherent risks including but not limited to minor injuries from physical activity, emotional distress, or property damage.
To the maximum extent permitted by law, Locked In Escape, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services or facilities.
Participants are responsible for any damage they cause to our property, whether intentional or accidental. Repair or replacement costs will be charged to the responsible party.
9. Intellectual Property
All content, designs, puzzles, storylines, and materials used in our escape rooms are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to:
- Room designs and layouts
- Puzzle mechanisms and solutions
- Audio and visual content
- Storylines and character development
- Website content and marketing materials
Participants may not photograph, record, or reproduce any copyrighted materials without written permission. Social media posts about your experience are welcome, but please respect our intellectual property and avoid sharing puzzle solutions or spoilers.
10. Privacy and Data Protection
We are committed to protecting your privacy and personal information. Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Service. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
We may use your contact information to send you updates about our services, special offers, and relevant information. You may opt out of these communications at any time by following the unsubscribe instructions in our emails or contacting us directly.
11. Force Majeure
We shall not be held liable for any failure or delay in performance of our services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government regulations, labor disputes, power outages, or other acts of God.
In such cases, we will make every reasonable effort to reschedule your booking or provide alternative arrangements. If rescheduling is not possible, we will provide a full refund.
12. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Ontario.
We encourage resolution of disputes through direct communication. If you have any concerns or complaints, please contact us first to seek an amicable resolution before pursuing legal action.
13. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
